1. Acceptance of Terms

By accessing or using the Sift platform ("Service"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you may not use the Service. These terms apply to all users of the platform, including employers, recruiters, and candidates.

2. Description of Service

Sift provides AI-powered adaptive technical assessments for engineering hiring. The Service includes candidate assessment creation, administration, scoring, and reporting tools for employers, as well as the assessment-taking experience for candidates. We continuously improve our platform and may update features, functionality, or content at any time.

3. User Accounts

To use certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Provide accurate and complete registration information
• Keep your account credentials secure and confidential
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activity under your account

4. Assessment Integrity

Candidates taking assessments through Sift agree to complete them honestly and independently unless the assessment explicitly permits collaboration or AI tool usage. Prohibited conduct includes:

• Sharing assessment questions or content with others
• Having another person complete an assessment on your behalf
• Using unauthorized tools or resources during an assessment
• Attempting to reverse-engineer, copy, or extract assessment content
• Exploiting bugs or vulnerabilities in the platform

Sift reserves the right to invalidate assessment results and terminate accounts for violations of assessment integrity.

5. Intellectual Property

All content on the Sift platform — including assessment questions, scoring algorithms, interface designs, and branding — is the intellectual property of Sift. You may not reproduce, distribute, modify, or create derivative works from any Sift content without our express written permission. Code written by candidates during assessments remains the candidate's intellectual property, though Sift retains the right to analyze it for scoring and quality improvement purposes.

6. Payment Terms

Sift offers usage-based pricing. Fees are charged per assessment or via pre-purchased bundles as described on our Pricing page. All payments are non-refundable unless otherwise stated. We reserve the right to modify pricing with 30 days' notice to existing customers. Unused bundle assessments do not expire.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We are committed to protecting your data, maintaining GDPR compliance, and never selling your information to third parties. Please review our Privacy Policy for full details on how we collect, use, and protect your data.

8. Limitation of Liability

Sift provides the Service "as is" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that assessment results will lead to specific hiring outcomes. To the fullest extent permitted by law, Sift's total liability for any claims arising from your use of the Service shall not exceed the total amount you paid to Sift in the 12 months preceding the claim.

9. Termination

Either party may terminate their account at any time. Sift reserves the right to suspend or terminate accounts that violate these terms. Upon termination, your right to access the Service ceases immediately. We will retain your data in accordance with our Privacy Policy and applicable legal requirements.

10. Modifications to Terms

We may update these Terms and Conditions from time to time. We will notify users of material changes via email or through the platform. Continued use of the Service after changes take effect constitutes acceptance of the revised terms.
